Stat. 94.55 on the federal basis — not more than 0.3 percent delta-9 THC — and neither excludes delta-8 and other isomers from that definition nor schedules them as controlled substances, so hemp-derived delta-8 is sold through ordinary retail channels. There is no state age floor, testing mandate or vendor permit specific to delta-8. Note that this rests entirely on the absence of a state prohibition: the federal hemp redefinition in P.L. 119-37 section 781, effective November 12, 2026, caps total THC rather than delta-9, and Wisconsin has no separate state framework that would preserve the current market.
