Prohibited outside the licensed cannabis system, and effectively prohibited altogether. E2SSB 5367 (effective July 23, 2023) redefined THC concentration to cover all THC, not just delta-9, and made any product containing THC a cannabis product — sellable only by a licensed cannabis retailer, so a smoke shop cannot stock it. Liquor and Cannabis Board Enforcement Bulletin 21-03 goes further: cannabis processors may not convert CBD or hemp into delta-8, and licensees may not buy or sell hemp-derived delta-8, with no exceptions. Do not order delta-8 into Washington.

No statewide kratom ban on record as of April 4, 2026. This reflects the absence of a known ban, not a state approval of kratom. No statewide kratom statute. Washington neither bans nor regulates kratom at the state level, so there is no state age floor, labeling rule or vendor registration. Local governments have filled the gap: several Washington cities and counties have enacted their own kratom bans or restrictions, and those ordinances are the binding constraint on a shop. Check your city and county before stocking. A statewide framework bill (HB 2291) was introduced in the 2025-26 session and has not been enacted.
