SF 0032 of 2024, signed March 7, 2024 and effective July 1, 2024, prohibits hemp containing THC or psychoactive substances, reaching delta-8 THC and its analogues through the controlled-substance definitions in W.S. 35-7-1002. Possession, sale and distribution of delta-8 are unlawful in Wyoming — shops cleared their inventory ahead of the effective date. Do not order delta-8 or comparable intoxicating hemp cannabinoids into Wyoming.
Kratom Status
21+ regulatedRegulated under W.S. 35-7-2201 through 35-7-2203 (SF 0056 of 2026, chapter 68, effective July 1, 2026). No sales to anyone under 21, no adulterated product, and 7-hydroxymitragynine may not exceed 2 percent of the product's alkaloid fraction. Every retail package must carry warnings against use by anyone under 21 or pregnant or breastfeeding, a warning that kratom may interact with medications and controlled substances, a keep-out-of-reach-of-children statement, the FDA disclaimer that the product is not intended to diagnose, treat, cure or prevent any disease, and quantitative declarations of mitragynine and 7-hydroxymitragynine per serving. Violations are a misdemeanor. A retailer avoids a criminal fine on a first offense by adopting and enforcing a written under-21 policy, and a third violation within two years exposes the retailer to a civil injunction. There is no kratom vendor registration or permit in Wyoming. Enforcement runs through the Department of Health, local law enforcement and the state chemist.
