Utah Smoke Shop Regulations

Flavored e-cigarette products other than tobacco and menthol are prohibited (effective Jan 1, 2025), and only registry-listed products may be sold — the registry itself lists only tobacco- or menthol-flavored products. Applies to all retailers, including retail tobacco specialty businesses.

Banned outside the medical cannabis system. Utah Code 4-41-402 prohibits the sale or use of any cannabinoid product unless it is on the state's registered cannabinoid product list or approved by the FDA, and delta-8 THC is a tetrahydrocannabinol reached by the Controlled Substances Act in Utah Code Title 58, Chapter 37 — so it cannot be registered and a smoke shop cannot stock it. The only lawful channel for THC products in Utah is the state medical cannabis program.

Regulated under the Utah Kratom Regulation Act (Utah Code ch. 4-45): labeling and product standards, with no sales to anyone under 21 (raised from 18 by SB 45, 2026). Kratom products must be registered with the state before sale (Utah Code 4-45-108); selling an unregistered kratom product carries an administrative fine, and unregistered product may be seized and destroyed.
