Kratom Status
21+ regulatedRegulated under the South Carolina Kratom Consumer Protection Act (S. 221, ratified May 8, 2025, effective sixty days after approval; S.C. Code art. 44-53-2000 et seq.). A kratom processor or retailer may not sell any kratom product to anyone under 21, may not sell product adulterated with a dangerous non-kratom substance or containing a poisonous or harmful ingredient or a controlled substance listed in S.C. Code 44-53-190, -210, -230, -250 or -270, and may not sell product containing a fully synthetic alkaloid including fully synthetic mitragynine or 7-hydroxymitragynine. Labels must meet the requirements of S.C. Code 44-53-2030, including a statement that sale or transfer to a person under 21 is prohibited. Violations carry civil penalties that escalate on a second or subsequent offense. There is no kratom vendor registration, permit or licence in South Carolina.
