Flavor Ban Status

Washington County's flavored-tobacco ban (Ordinance 878) was upheld unanimously by the Oregon Supreme Court on May 7, 2026, and Multnomah County has an enacted ban in litigation — Portland-metro shops must check their county's rules before stocking flavored products.
Delta-8 / Hemp Status
regulatedRestricted to the licensed cannabis market. HB 3000 (2021) gave the OLCC authority over artificially derived cannabinoids; under OLCC rules (OAR 845-026) they may not be sold at general retail except in narrow circumstances, so smoke shops cannot stock delta-8.
Kratom Status
21+ regulatedRegulated under the Oregon kratom law (HB 4010, 2022): no sales to under-21; kratom processors must register with the Department of Revenue, with sale standards operative since July 1, 2023 (OAR); the DOR registration program is still in development.
