legalLegal by hemp exemption, untested. Mississippi's Schedule I THC listing excludes hemp and hemp products regulated under the state hemp cultivation act (Miss. Code 41-29-113(d)(31)), and there is no state age or testing regime for hemp-derived delta-8. The exemption's reach for intoxicating products has not been tested in court, so stock cautiously.
Kratom Status
21+ regulatedRegulated under HB 1077 (2025, effective July 1, 2025): no sales to anyone under 21, kratom products must be placed behind the retailer's counter, and every retail sales clerk must be notified of the law in writing and sign an agreement to observe it. Retailers, wholesalers, distributors and manufacturers must register with the Mississippi Department of Revenue before selling, which has applied since October 1, 2025. Products are capped at 1 percent 7-hydroxymitragynine of total kratom alkaloids and one-half milligram per container. Many Mississippi counties and cities have their own local kratom bans, which HB 1077 expressly preserves; check local ordinances.

Code 75-102-2): manufacturers must certify products keyed to FDA PMTA status by September 1, 2026, and the Mississippi ENDS Product Directory publishes October 1, 2026, after which unlisted ENDS products cannot be sold.
