Delta-8 / Hemp Status
regulatedRegulated. Hemp-derived cannabinoid products sell only within the Office of Cannabis Management framework (Minn. Stat. ch. 342): lower-potency hemp edibles and beverages through registered or licensed retailers, 21+, with per-serving THC caps; inhalable hemp-derived products are not authorized for general retail. The former Minn. Stat. 151.72 regime was repealed in 2026 and absorbed into the OCM system.
Kratom Status
21+ regulatedRegulated. Minn. Stat. 152.027 subd. 7 makes it a gross misdemeanor to sell kratom, or any substance containing mitragynine or 7-hydroxymitragynine, to a person under 21, and possession by an underage person is a misdemeanor. The age was raised from 18 to 21 by 2026 Minn. Laws ch. 63 (H.F. 3453), signed May 5, 2026 and effective August 1, 2026. There is no vendor registration, permit or manufacturing standard: Minnesota regulates the counter, not the supply chain.
