Kratom Status
21+ regulatedRegulated under the Florida Kratom Consumer Protection Act (Fla. Stat. 500.92): sales to anyone under 21 are prohibited. FDACS rule 5K-4.030 requires every establishment distributing kratom products to hold a Food Establishment permit under Fla. Stat. 500.12, applies 21 C.F.R. Part 111 manufacturing standards, and governs packaging and labeling. Retailers must post a sign adjacent to the display reading: THE SALE OF KRATOM TO PERSONS UNDER THE AGE OF 21 IS PROHIBITED. PROOF OF AGE IS REQUIRED FOR PURCHASE. Kratom may not be sold through vending machines, or by self-service unless age is verified before access, and mailed or delivered orders require age confirmation before delivery. Violations can bring stop-sale orders, permit suspension or revocation, and administrative fines.

Florida runs a nicotine dispensing device directory with opposite polarity to PMTA registry states: the Attorney General lists single-use and disposable devices deemed attractive to minors (Fla.
