Delta-8 / Hemp Status
bannedBanned from general retail in two steps. CDPH emergency regulations (DPH-24-005), effective Sep 23 2024, first pulled intoxicating hemp ingestibles by requiring no detectable total THC in hemp food, beverages, and dietary supplements. AB 8 (Aguiar-Curry, 2025) then codified and expanded that, effective Jan 1 2026, banning all inhalable/smokable hemp (flower, prerolls, vapes) regardless of THC content and prohibiting synthetic cannabinoids including delta-8, delta-10, and HHC. Ingestible hemp extract must be >99% pure with no detectable THC; only CBD and CBN isolate qualify for general retail. B&P Code §22980.6 bars licensed tobacco retailers from possessing intoxicating hemp. DCC licensing, track-and-trace, and a 15% cannabis excise begin Jan 1 2028.
