Kratom Status
18+ regulatedRegulated. The Kratom Control Act (720 ILCS 642) prohibits knowingly selling, buying for, distributing samples of or furnishing any product containing kratom to anyone under 18, and bars a person under 18 from knowingly purchasing or possessing it or using false identification to obtain it. A sale to a minor is a Class B misdemeanor carrying a fine of not less than $500. Illinois has no kratom vendor registration, permit, labeling standard or potency cap: the Act regulates the counter, not the supply chain. A broader Illinois Kratom Consumer Protection Act (HB 4737 of 2026) would have repealed and replaced this Act, but it was re-referred to the Rules Committee on March 27, 2026 and is not law.
